  2. Type your voucher code (found within your policy documentation) into the ‘voucher code’ text box and then click ‘validate voucher’.
  3. Fill out your name and email address, create a password, and specify what type of business you have.
  4. Validate your email address by clicking the link in the confirmation email that you’ll receive.

Frequently asked legal questions

My policy

Will my policy cover any legal dispute?

The legal disputes covered by your policy are shown in the policy wording, to be read in conjunction with your policy schedule. However, the legal advice helpline is available to offer guidance on legal matters affecting your business even if it falls outside the scope of the legal expenses cover.

If I have a legal problem before my policy starts will this still be covered?

Anything that you’re aware of before the start of your policy is excluded.

What if I just want some standard employment advice?

You can call our legal advice team (using the number found in your policy documentation or via Aviva Businesslaw) at any time to discuss employment issues. This won’t impact your renewal premium/quotation. Alternatively, you can find comprehensive guides, videos and templates on almost any employment question on Aviva Businesslaw. Just follow the registration steps listed above.

Will I be able to choose my own solicitor?

In certain situations you could be entitled to choose you own representation. However, DAS-preferred lawyers are a more convenient option. They have expertise in specific claim areas and may have better rates, which helps your policy cover go further. All of the preferred law firms must comply with agreed service standard levels which are audited regularly. This ensures their decisions are completely impartial. In addition, DAS-preferred lawyers will understand legal expenses policies and have in depth experience of dealing with legal expenses insurance claims, which could help progress your claim faster.

Cost and fees

What do "legal costs" include?

This will include solicitors or barristers fees and charges for disbursements, not to mention the opponent’s costs should you lose and be liable to pay them.

What happens if my own solicitor begins work on my dispute before I notify you and I incur costs?

Any legal problems which started before the date your cover begins are excluded.

What happens if my legal costs exceed my limit of indemnity?

The limit of indemnity shown in your policy schedule is the maximum that would be paid out in the event of a claim. You’ll be informed if your case is likely to exceed the limit, and you will be responsible for any costs over the limit of indemnity.

I’m considering the unfortunate prospect of having to make some redundancies. When should I advise my legal expenses insurer?

It’s always strongly advised, and in certain cases a condition of the policy cover, that you seek legal advice from us as soon as possible to ensure the correct procedures are followed from the start.

Making a claim

If I speak to your legal advisors does this automatically trigger a claim?

No.  If you call the legal advice helpline to discuss a problem that might lead to a claim, the legal advisor will support you with identifying whether you have a claim and advise you how best to register a claim, in most instances this will be to complete an online claim form.

What happens if I’m not happy with the way the appointed solicitor is dealing with my claim?

If there is a disagreement about the handling of a claim, you should contact your claims department, who will support you in resolving this issue. Alternatively, you can refer to the solicitors own complaint procedure.

Why might my claim end up being a negotiated settlement rather than going to court?

It’s often more beneficial for both parties to try and reach a settlement, rather than go to court. The majority of legal disputes are in fact settled by negotiation. We’ll always provide the most appropriate solution to your legal dispute, which may entail entering into negotiation as the fastest and most effective way of resolving things.
